監警會今日(17日)與投訴警察課代表舉行例會,其中公開會議部分的議程,包括簡報警務人員的心理輔導服務、網絡「起底」及假新聞;並會報告投訴警察課的每月統計數字、涉及《逃犯條例》修訂有關大型公眾活動衍生的投訴統計數據,以及投訴警察課刑事及違反紀律事項一覽表。

早前獲特首林鄭月娥會委任加入監警會的大律師公會前主席林定國及前教育署署長余黎青萍首度出席會議。
警方心理學家:有警員埋怨被當殺父仇人

警務處高級臨床心理學家麥詠芬表示,2010年警察學院開始為警員提供正向心理學作訓練課程,至2018年已進行至少6次大型的訓練,以應對示威時可能遇到的挑釁,前線不少警員已接受相關的訓練,而機動部隊的人員更必須8小時的心理訓練。

她又指,反修例活動中示威者的暴力升級等,甚至所住的宿舍也遭受衝擊等,加上工作時間長達30多小時,使警員承受極大壓力,有警員遺憾因此未能出席子女第一次人生畢業禮。她提到「有前線不明白示威者為何會將他們當作殺父仇人」,加上傳媒的負面報道,令他們感到十分難過;同時,假新聞在網上流傳使社會的「仇警」加劇,社會對警員的尊重越來越少。

[Reuters] Hong Kong leader to hold dialogue aimed at easing tensions

HONG KONG (Reuters) - Hong Kong's leader, Carrie Lam, said on Tuesday
she and her team would begin dialogue sessions with the community next
week, while reiterating that violence that has roiled the city over
three months of protests must end.

Lam, who is under pressure from Beijing to defuse the public anger
stirring the protests, said the dialogue sessions would be as open as
possible, with members of the public able to sign up to attend.

"Hong Kong society has really accumulated a lot of deep rooted economic,
social and even political issues, I hope these different forms of
dialogue can provide a platform for us to discuss," Lam told reporters
at a weekly briefing.

She said the issues included housing and land shortages in one of the
world's most densely populated cities of 7.4 million. Young people are
particularly frustrated by the high cost of finding a place of their own
to live.

"But I have to stress here, dialogue platform doesn't mean we don't have
to take resolute enforcement actions. Suppressing the violence in front
of us is still the priority," she said.

The former British colony has been roiled by nearly four months of
sometimes violent protests.

The trigger for the unrest was an extradition bill, now withdrawn, that
would have allowed people to be sent from Hong Kong to mainland China
for trial.

But the demonstrators' demands have broadened to include universal
suffrage and an independent inquiry into their complaints of excessive
force by the police.

Hong Kong returned to China in 1997 under a "one country, two systems"
formula that guarantees freedoms not enjoyed on the mainland - including
a much-cherished independent legal system.

But many residents complain about what they see as creeping interference
by Beijing in Hong Kong's affairs despite the promise of autonomy.

Lam, who has been a focus of protesters' anger, capitulated to one of
their main demands on Sept. 4, announcing the full withdrawal of the
extradition bill.

But some said that was too little, too late, and the protests have
continued.

'EROSION'
Police on Monday said 89 people were arrested over the weekend after
"radical protesters" attacked two police officers on Sunday evening,
hurling petrol bombs and bricks.

Brawls also broke out between anti-government protesters and others who
support Beijing.

Nearly 1,500 people have been arrested since the protests intensified in
June.

The turmoil is beginning to hit the economy of the financial hub.

Credit rating agency Moody's changed its outlook on Hong Kong's rating
to negative from stable on Monday, reflecting what it called the rising
risk of "an erosion in the strength of Hong Kong's institutions".

The institutional features that grant Hong Kong greater political and
economic autonomy — together with the city's intrinsic credit strengths
— accounted for its higher rating than China, the agency said.

Lam said the Moody's decision disappointing.

"We do not concur, especially if the justification for that sort of
change in outlook is premised on whether we're still upholding 'one
country two systems'," she said.

China also says it is committed to "one country two systems" and it
denies meddling in Hong Kong while stressing it is an internal Chinese
issue.

China has accused foreign powers, particularly the United States and
Britain, of fomenting the unrest and told them to mind their own business.

[The Times] Brexit: Tory anger as Boris Johnson ambushed in Europe

Boris Johnson was ambushed yesterday by the leader of the EU's second-smallest state who mocked his Brexit strategy after the prime minister withdrew from a press conference to avoid protesters.

In an extraordinary break with protocol Xavier Bettel, prime minister of Luxembourg, stood next to an empty lectern and berated Mr Johnson to cheers from anti-Brexit campaigners.

He accused his British counterpart of putting "party political gain" over the interests of his citizens and warned that the EU needed "more than words" to strike a new Brexit deal. He ridiculed suggestions that Mr Johnson could defy parliament and refuse to ask for a further Brexit extension, saying: "This would not happen in Luxembourg."

The performance prompted a diplomatic spat that marred the prime minister's efforts to win support for a new deal. Mr Bettel was accused of "unhelpful grandstanding".

In what appeared to be a deliberate ambush Mr Bettel's team had refused requests by Downing Street to move a scheduled press conference between the two leaders away from a noisy demonstration by British anti-Brexit protesters.

When Mr Johnson then declined to take part in the joint appearance Mr Bettel went ahead alone, leaving an empty podium and the British flag still fluttering behind him.

He proceeded to lambast Mr Johnson's plans to inject urgency into the Brexit negotiations. Asked by reporters whether Downing Street could be pursuing a sham negotiation in order to pin the blame on the EU for a no-deal Brexit, he replied: "I told him, 'I hear a lot but I don't read a lot.'" He added: "If they want to discuss anything we need to have it written [down]."

Mr Bettel's conduct drew a hostile reaction from Tory Brexiteers. The former party leader Iain Duncan Smith said: "The irony is that Luxembourg was saved by Britain. National leaders should always treat one another with courtesy and civility. Good ones do."

The negative reaction was not limited to Brexiteers. Sir Nicholas Soames, one of 21 MPs expelled by Mr Johnson for voting to block no-deal, accused Mr Bettel of "unhelpful grandstanding".

Mr Johnson held his first meeting with Jean-Claude Juncker, president of the EU Commission, also in Luxembourg. They agreed to speed up Brexit talks, with the two sides expected to meet daily in Brussels. The prime minister told the BBC that he was "cautiously optimistic" about a deal.

【明報專訊】警方稱周日示威者在金鐘政府總部一帶使用逾80枚汽油彈,並在灣仔朝兩名交通警投擲至少3枚汽油彈,兩警一度舉槍示警。香港警察隊員佐級協會主席林志偉昨日發聲明,稱警員很有可能視作致命攻擊而用「實彈槍械」對付擲汽油彈的示威者。警方其後在記者會上回應,此情况下用真槍是「相當合情合理」。有人權組織批評用實彈槍言論極不恰當,認為過度簡化使用致命武力的決定及考慮因素,說法加劇警民對立,混淆警員對使用致命武力指引的理解。

百日拘1453人 「暴力已失控」

警察公共關係科總警司謝振中在警方例行記者會稱,由6月9日至9月15日共有1453人被捕;又提及周日示威衝突情况,稱前日下午約5時「暴徒」用彈叉朝政總擲磚及雜物,在政總一帶使用超過80枚汽油彈,其中水炮車被擲中起火,有示威者亦被擲中,另有示威者於港鐵灣仔站高處向樓梯下警員擲汽油彈,形容「暴力行為已去到失控地步」。前日下午約5時45分約20人在告士打道近馬師道交界向兩名交通警投擲最少3枚汽油彈,他形容行為「直頭想攞我們兩個交通警員的生命」,兩人為保護自己及同事安全拔槍示警,表現英勇及克制,武力是需要及合理。

兩交通警遭擲3彈 拔槍制止

香港警察隊員佐級協會主席林志偉發聲明,形容「暴徒」襲擊持不同意見市民及有組織地以汽油彈攻擊警員,對此予以最嚴厲譴責。他形容用汽油彈是「無容置疑的致命武器」,「每當有暴徒將汽油彈舉起作投擲之勢,現場的警務人員很有可能會視作對自身或其他人的致命攻擊而使用相應的武力或武器制止,包括實彈槍械」。他又稱在危機面前,「當下的適當決定」能保護自己及他人安全。
被問到警方是否認同言論、日後會否用實彈對付使用汽油彈的示威者等,行動部警司方志堅說,《警察通例》有列明警員在什麼情况可用槍械,包括警員要保護任何人包括自己,免身體受嚴重傷害。他反問:「大家認不認同被擲汽油彈會令身體受到嚴重傷害?如果認同的話,相信在此危急情况下使用槍械,我相信是相當合情合理。」不過他說不會評論是否警員一遇到使用汽油彈的人便會使用槍械,因用槍有嚴謹守則,警員在現場會根據專業判斷,克制地作決定。
民權觀察認為林志偉以概括情境解說警員可用實彈槍攻擊及制服持汽油彈的示威者,「言論極不恰當」,過度簡化使用致命武力的決定及考慮因素,說法只會加劇警民對立,或令警員誤以為警方放寬使用致命武力原則。民權觀察強調警員只可在自身或他人性命受迫切威脅及無法使用更低程度武力制服,才可考慮用實彈槍械。香港人權監察對有關實彈槍言論表示遺憾,稱示威現場往往人群密集,警員對個別有暴力行為的人開槍,須考慮其他示威者、記者、救援人員等人安全,包括會否可能被流彈所傷或殺害。

民主派會議召集人毛孟靜質疑為何協會可代表警隊提出此說法,並指是否使用實彈制止屬警方行動指引。她又認為汽油彈與實彈威力不可作比較,「武力不是相等」。

早上八時許,港鐵東鐵綫紅磡站對開有載客列車出軌,現場相片可見,列車的車廂分離,車門爆開,現場消息指有三人不適。紅磡至旺角東站服務暫停。
旺角東至羅湖維持6分鐘一班車,旺角東至落馬洲站維持18分鐘一班車;西鐵綫服務需要相應作出調整,紅磡來回屯門站,12分鐘一班車,南昌來回屯門站,6分鐘一班車。

香港抗爭者寄望美國國會通過《香港人權與民主法案2019》(Hong Kong Human Rights
and Democracy
Act,下稱《法案》),以促成「攬炒」與中央博奕,有學者認為《法案》為美國對中方施壓提供新招數,對港聲譽的影響不但可能擾亂中央極度重視的大灣區規劃,也可能有助阻撓香港推出「加辣版23條」,而若確立對抗爭者的簽證保障,更或能促進其他國家仿效,間接對北京構成壓力,但始終通過與否權力仍在總統特朗普手中,有學者指不應高估《法案》對北京構成的壓力。

港大政治與公共行政學系榮譽講師袁彌昌接受《蘋果》訪問時指,新的《法案》是《美港政策法》(United
States–Hong Kong Policy Act)及《全球馬格尼茨基法案》﹙《The Global Magnitsky
Human Rights Accountability
Act》﹚的綜合版本,一方面要求國務卿提交《美港政策法》年度報告,向國會論證香港自治狀況,以檢視是否繼續賦予香港特殊地位待遇,另一方面又要求美國總統向國會提交被指涉及銅鑼灣書店等事件、打壓香港基本自由的制裁人員名單,這些人或被凍結在美的資產或拒絕入境,認為此法案「可以有啲中間唔同嘅選項」,增加美方對中國施壓選項。

《法案》讓美國在中國議題有更大空間運用「香港牌」,因《法案》要求商務部每年向國會提交有關香港就敏感及軍民兩用技術出口管制情況、北京有否借香港在大灣區的角色轉移相關技術到中國。袁指,有關評價或影響香港國際地位聲譽,暫仍靠香港「走出去」的大灣區規劃或被打亂,《法案》也指明香港日後為《基本法》23條立法時,總統及國務卿須審視相關法律有否牴觸《中英聯合聲明》及國際人權法規,「佢個意思係想過一條加辣版23條,你(香港)諗都唔使諗」。
袁指《法案》另一項令中央「頭痛」之處,是免去因參與2014年社會運動或其他人權抗爭而被拘控或判囚人士,在申請美國簽證時的限制,相信涵蓋範圍會延伸至反修例抗爭者,有望外國會仿效,「佢(《法案》)亦都叫like-minded、同美國諗法相近國家去推動(類似簽證政策),好幾個月前已出現黃台仰流亡做咗德國難民事件,令啲人對香港司法制度(的)信心受影響,大陸亦恨得牙癢癢」。

中央如何接招是未知數,但會否如民建聯前立法會主席曾鈺成所言,欲以《法案》迫使中央改變對港政策是「發夢」?袁直言港人不應期望過高,因「攬炒」的前提是假設香港獨立關稅區對中國具重要性,「中央短期內都搵唔到替代品,但唔好完全乜可能性都抹殺」,加上《法案》的制裁機制中,理論上雖可一併針對涉及相關事件的中央官員,惟袁相信主要仍是希望阻嚇特區官員,料首個試金石為11月區選,「可能係選舉主任,(或會諗)冇必要為咗DQ而令我個人受懲罰或受制裁。」
袁指《法案》通過前要視乎香港抗爭者如何把握機會推動美方工作,首要拿捏勇武程度;至於為香港民主運動帶來的實際影響,則視乎國際戰線有否擴大,他贊成政界及民間團體到其他國家促請當地仿效美國的《法案》,「要令上面(中央)了解(對港干預)行動要付出乜代價」,迫使中央盡早意識要評估得失。

中大政治與行政學系助理教授黃詩朗則表示,《美港政策法》一直為美國提供法律基礎檢視香港狀況,總統可以行政方式終止香港獨立關稅區的特殊地位,「攬炒機制一直存在」,並指一手推動法案的參議院魯比奧亦形容取消香港獨立關稅區是「核武選項」,意味在港美國利益一同攬炒,到了與中共「擘面」的地步,但觀乎過往除了香港較風平浪靜之時暫停撰寫報告,美國國務院都有提交報告,大多指香港仍享有足夠自治,「真係要做嘢嘅係總統,國務卿都係總統揀,有心郁香港,唔會話寫香港冇問題。」又指美國外交政策為較分散的制度,國會層面針對中國議題普遍認同要比較強硬,未必代表行政機關意思,加上美國總統特朗普本身亦不太注重人權問題,「國會(發聲)攞彩未必係美國總統想做」。
黃認同《法案》提出其他較具彈性的招數,包括懲罰官員機制,但「做咗有冇可能影響香港或北京,(我)係抱懷疑態度。」因為相比領土完整、面子問題,香港官員所受影響對中共而言是「好細嘅嘢」,即使法案要求商務部檢視香港是否被利用為中共白手套,轉移敏感技術北京影響會較大,但同時會加速北京想辦法減低依賴外國技術及香港作為內地轉口貿易的角色,「中國政府唔會想被人牽住鼻子走」。
